Terms of Use, Privacy Policy & Copyright Notice

By using the BetterSafeRadio.com site and/or purchasing our products, you hereby agree to be bound by the following Store Terms, Terms of Use, Privacy Policy & Copyright Notice.

Store Terms:

By using or purchasing from the BetterSafeRadio.com store, you hereby agree to these terms:

BetterSafeRadio offers a 30-Day Money-Back Guarantee on all items*. All radios are guaranteed to NOT be DOA. We will replace a DOA radio with a new item after inspecting the radio. We will repair, replace, credit or refund all other items, excluding digital products, within 30 days. Some items have extended manufacturer warranty periods – See radio warranty terms below. All items must be in original condition with all parts, manuals & packaging. No credit given for original shipping fees. Contact us for an RMA# before returning all items. Customer pays for return shipping. Up to a 20% restocking fee + original payment processing fees (4% of original total payment) for all cancelled special orders/backorder or returns (except DOA radios and defective items returned within 30 days) may apply, at my sole discretion, based on the condition of the returned gear and packaging. 30-Day Returns must be shipped within 10 days of the RMA issue date or additional restocking fees may apply.

Packages valued at $500 or more require a delivery signature. CA Sales Tax will be added to all California orders. I DO ship to PO Boxes via USPS. Sorry, no international or APO/FPO packages at this time unless you use a 3rd-party package forwarding service such as Stackry.com.

Refunds for all cancelled orders, pre-orders and backorders will incur a 4% restocking/payment processing fee deduction (of refund amount, 5.5% for international cards, $1 minimum for refunds on orders of $10 or less)Purchase wisely!

Order cancellations for shipments that are already packed will incur an additional 3% service fee (on the original order total) on refunds, store credits, holds or modifications.

Your Shipping Address MUST match your PayPal/venmo account (no shipping address changes for orders with PayPal/venmo payments).

No refunds/returns for digital products & services (codeplugs or consulting/programming services), or opened/downloaded serialized software or boxed programming kits.

I reserve the right to refuse service or sales to anyone, at my discretion, for any reason. If you threaten or harass me in any way, I reserve the right to cancel and refund your order, per the terms herein, with a 4% payment processing fee deduction.

I reserve the right to refuse exchanges and refunds for radios that have been reprogrammed, reset, damaged or disabled due to user negligence or misuse, or altered in any way, unless doing so was a troubleshooting step coordinated with BSR. I am not responsible for radios “bricked” (made unusable) due to using programming software and/or cables not sold by BSR or the original manufacturer as compatible with a specific radio. If you refuse to take reasonable tech support/troubleshooting steps with my guidance and return gear that is not in 100% re-sellable condition, the restocking fee will apply. If your warranty return is deemed to not be defective or the problem is caused by user negligence or misuse, or if you refuse warranty repair or replacement, or if your 30-day return shows signs of misuse or damage, or if any gear is not returned in re-sellable condition or is missing any parts or packaging materials, we may assess a fair market used or “open-box” value for your refund amount, minus any assessed restocking fees, the original shipping fees, and the original 4% payment processing fees. If you refuse this assessment, we will optionally return your gear to you at your expense (pre-paid), unless you forfeit such, in which case we will keep the gear and you will waive your right to any return or refund.

*Two-way radio earpieces and headsets that fit either in or over the ear are non-returnable for sanitary reasons. Sorry, we are unable to accept returns requests for these items for any reason. No exceptions. Close-Out items are non-returnable unless they are completely DOA or damaged in shipping. Photos are required to show any shipping damage before unpacking items and a damage claim must be made with the carrier under penalty of fraud. No refunds for digital products such as programming codeplug files once the file has been sent or downloaded, or opened serialized software or boxed programming kits.

Due to international shipping restrictions, we’re currently only shipping to the United States (including Puerto Rico and other US Territories). Sales to Canada are permitted, but you must use a package forwarding service like Stackry.com for shipping. Also note that most of my GMRS radios are not legal in Canada or other countries. Shipping insurance is included in all shipping fees.

All Li-ion batteries MUST be sent via Priority Mail: 2 radios or 1 radio + 1 spare battery for 2 batteries total per package. Orders with spare batteries (without a radio) must use Priority Mail surface transport only, which may take longer (5 lbs. max.). Orders exceeding these battery limits may require an additional package with extra shipping fees – I will contact you before processing these orders.

Orders typically processed in 12-96 hours unless backordered (see homepage for processing estimates and backorder status on popular items). All payments are processed when order is placed, including for backordered items.

Orders will be held until all items are in stock and can ship together, unless you want to pay an additional amount for incremental shipping (Contact me to request such). We will attempt to notify you of any delays or unforeseen backorders. Please check the BSR homepage before ordering for the latest backorder/processing status & estimates on popular items. Contact me for availability or any other questions before placing your order.

No refunds for custom programming/consulting time already performed at the time of an order cancellation or modification. All additional custom programming/consulting fees must be paid before order can be shipped.

If you cancel or modify a purchase for special-order items that have already been ordered, you may be liable for a 20% restocking fee or an extended delay on any credit or refund (until we have the funds available for such), at our sole discretion.

Because there are so many factors that can affect performance and range of RF communications, BetterSafeRadio makes no guarantee whatsoever of your effective operating range or radio performance.

Equipment and packaging may differ slightly from that displayed in the online store, including the color and labeling on equipment and packaging.

The radio customer programming software available here as a free download is provided by the manufacturer as a courtesy and is not guaranteed to be compatible with every possible computer system, available in the future, or updated in the future. While nearly everyone has success operating the software, sometimes after several free BSR support sessions, the software does not constitute part of a radio product and the inability to successfully operate the software does not constitute a DOA, incomplete, or dysfunctional radio product.

The customer is solely responsible for the proper and legal use of their equipment per all Federal (including FCC), State & Local regulations and laws.

We reserve the right to refuse service & sales to anyone, at our sole discretion. We reserve the right to change these Store Terms at any time and without notice.

Warranty Terms

Most radio brands offer a 1-year manufacturer’s warranty on the radio, and a 6-month warranty on the battery pack, desk charger and other accessories. See the individual product pages for details.

Like most website operators, BetterSafeRadio collects non-personally-identifying information of the sort that web browsers and servers typically make available, such as the browser type, language preference, referring site, and the date and time of each visitor request. BetterSafeRadio’s purpose in collecting non-personally identifying information is to better understand how BetterSafeRadio’s visitors use its website. From time to time, BetterSafeRadio may release non-personally-identifying information in the aggregate, e.g., by publishing a report on trends in the usage of its website.

BetterSafeRadio also collects potentially personally-identifying information like Internet Protocol (IP) addresses for logged in users and for users leaving comments on BetterSafeRadio.com blogs/sites. Gathering of Personally-Identifying Information

Certain visitors to BetterSafeRadio’s websites choose to interact with BetterSafeRadio in ways that require BetterSafeRadio to gather personally-identifying information. The amount and type of information that BetterSafeRadio gathers depends on the nature of the interaction. For example, we ask visitors who sign up at BetterSafeRadio.com to provide a username and email address. Those who engage in transactions with BetterSafeRadio are asked to provide additional information, including as necessary the personal and financial information required to process those transactions. In each case, BetterSafeRadio collects such information only insofar as is necessary or appropriate to fulfill the purpose of the visitor’s interaction with BetterSafeRadio. BetterSafeRadio does not disclose personally-identifying information other than as described below. And visitors can always refuse to supply personally-identifying information, with the caveat that it may prevent them from engaging in certain website-related activities.

BetterSafeRadio uses cookies to help BetterSafeRadio identify and track visitors, their usage of BetterSafeRadio website, and their website access preferences. BetterSafeRadio visitors who do not wish to have cookies placed on their computers should set their browsers to refuse cookies before using BetterSafeRadio’s websites, with the drawback that certain features of BetterSafeRadio’s websites may not function properly without the aid of cookies.

Business Transfers

You acknowledge that such transfers may occur, and that any acquirer of BetterSafeRadio may continue to use your personal information as set forth in this policy.

Ads

Ads appearing on any of our websites may be delivered to users by advertising partners, who may set cookies. These cookies allow the ad server to recognize your computer each time they send you an online advertisement to compile information about you or others who use your computer. This information allows ad networks to, among other things, deliver targeted advertisements that they believe will be of most interest to you. This Privacy Policy covers the use of cookies by BetterSafeRadio and does not cover the use of cookies by any advertisers.

Privacy Policy Changes

Although most changes are likely to be minor, BetterSafeRadio may change its Privacy Policy from time to time, and in BetterSafeRadio’s sole discretion. BetterSafeRadio encourages visitors to frequently check this page for any changes to its Privacy Policy. Activity Log
This feature only records activities of a site’s registered users, and the retention duration of activity data will depend on the site’s plan and activity type.

Data Used: To deliver this functionality and record activities around site management, the following information is captured: user email address, user role, user login, user display name, WordPress.com and local user IDs, the activity to be recorded, the WordPress.com-connected site ID of the site on which the activity takes place, the site’s Jetpack version, and the timestamp of the activity. Some activities may also include the actor’s IP address (login attempts, for example) and user agent.

Activity Tracked: Login attempts/actions, post and page update and publish actions, comment/pingback submission and management actions, plugin and theme management actions, widget updates, user management actions, and the modification of other various site settings and options. Retention duration of activity data depends on the site’s plan and activity type. See the complete list of currently-recorded activities (along with retention information).

Data Synced (?): Successful and failed login attempts, which will include the actor’s IP address and user agent.

Gravatar Hovercards
Data Used: This feature will send a hash of the user’s email address (if logged in to the site or WordPress.com — or if they submitted a comment on the site using their email address that is attached to an active Gravatar profile) to the Gravatar service (also owned by Automattic) in order to retrieve their profile image.

Infinite Scroll
Data Used: In order to record page views via WordPress.com Stats (which must be enabled for page view tracking here to work) with additional loads, the following information is used: IP address, WordPress.com user ID (if logged in), WordPress.com username (if logged in), user agent, visiting URL, referring URL, timestamp of event, browser language, country code.

Activity Tracked: Page views will be tracked with each additional load (i.e. when you scroll down to the bottom of the page and a new set of posts loads automatically). If the site owner has enabled Google Analytics to work with this feature, a page view event will also be sent to the appropriate Google Analytics account with each additional load.

Sharing
Data Used: When sharing content via email (this option is only available if Akismet is active on the site), the following information is used: sharing party’s name and email address (if the user is logged in, this information will be pulled directly from their account), IP address (for spam checking), user agent (for spam checking), and email body/content. This content will be sent to Akismet (also owned by Automattic) so that a spam check can be performed. Additionally, if reCAPTCHA (by Google) is enabled by the site owner, the sharing party’s IP address will be shared with that service. You can find Google’s privacy policy here.

WordPress.com Stats
Data Used: IP address, WordPress.com user ID (if logged in), WordPress.com username (if logged in), user agent, visiting URL, referring URL, timestamp of event, browser language, country code. Important: The site owner does not have access to any of this information via this feature. For example, a site owner can see that a specific post has 285 views, but he/she cannot see which specific users/accounts viewed that post. Stats logs — containing visitor IP addresses and WordPress.com usernames (if available) — are retained by Automattic for 28 days and are used for the sole purpose of powering this feature.

Activity Tracked: Post and page views, video plays (if videos are hosted by WordPress.com), outbound link clicks, referring URLs and search engine terms, and country. When this module is enabled, Jetpack also tracks performance on each page load that includes the Javascript file used for tracking stats. This is exclusively for aggregate performance tracking across Jetpack sites in order to make sure that our plugin and code is not causing performance issues. This includes the tracking of page load times and resource loading duration (image files, Javascript files, CSS files, etc.). The site owner has the ability to force this feature to honor DNT settings of visitors. By default, DNT is currently not honored.

Comments
When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

Media
